Terms of Service for Pine Point Property Inspections

1. Acceptance of Terms

By scheduling or engaging the services provided by Pine Point Property Inspections (“PPPI,” “we,” “our,” “us”), you (“Client,” “you,” “your”) agree to be bound by these Terms of Service (“Terms”). Please carefully review these Terms before scheduling your inspection.

2. Definitions

  • Inspection: A visual and non-invasive evaluation of readily accessible areas of the primary dwelling, including attached garages and visible structural components. Outbuildings or separate structures are inspected only if explicitly agreed upon.
  • Readily Accessible Areas: Areas easily visible without moving furniture, stored items, appliances, or dismantling structures.
  • Advanced Technologies: PPPI uses thermal imaging cameras and drones for roof inspections as needed and at the inspector’s discretion.

3. Scope of Services

PPPI provides home inspection services that are visual and non-invasive, in compliance with the Standards of Practice set forth by the International Association of Certified Home Inspectors (InterNACHI). The inspection covers readily accessible areas of the property, including visible structural components and systems, but excludes areas that are hidden, obstructed, or inaccessible.

  • Readily Accessible Areas: These are areas that can be visually examined without moving furniture, stored items, appliances, or dismantling structures.
  • Advanced Technologies: PPPI may use advanced technologies, such as thermal imaging cameras and drones, for specific inspections, including roof evaluations, at the inspector’s discretion.

4. Limitations of Inspection

The inspection is limited to the visual and non-invasive evaluation of the accessible areas only. It does not include invasive procedures, nor does it cover hidden defects or areas that are not visible or accessible during the inspection, such as behind walls or under flooring. The inspection also does not assess compliance with local, state, or federal building codes and does not address environmental hazards (e.g., mold, asbestos, lead paint), unless otherwise specified in writing.

5. Inspection Reports

After the inspection, you will receive an inspection report via email by the next business day. This report reflects the conditions observed during the inspection and is not a warranty or guarantee regarding the future condition or performance of the property or its systems. The report is intended solely for your use and provides no coverage for defects that were not visible at the time of inspection.

6. Payment and Fees

Payment for the inspection is due before or at the time of the inspection, unless alternative arrangements have been made. Accepted methods of payment include credit/debit cards, checks or cash. Late payments are subject to an interest charge of 1.5% per month (or the maximum rate permitted by law), and returned payments may incur additional fees. Deposits, if required, are non-refundable once the inspection has commenced.

7. Cancellation and Rescheduling Policy

If you need to cancel or reschedule your inspection, you must notify PPPI by phone or email at least 24 hours before the scheduled appointment. Cancellations or rescheduling requests made within 24 hours of the scheduled inspection will incur a fee equal to 50% of the inspection cost. PPPI reserves the right to reschedule the inspection at no penalty in cases of severe weather, emergencies, or inspector unavailability.

8. Liability and Limitations

PPPI’s liability for any claims arising from the inspection is limited to the fee paid for the inspection. PPPI is not liable for any indirect, consequential, or incidental damages, including, but not limited to, property damage, loss of business, or repair costs related to undiscovered defects. Claims must be made in writing within 30 days of the inspection, and any legal action must commence within one (1) year from the date of the inspection.

9. Client Responsibilities

You are responsible for ensuring that the property is accessible at the time of the inspection and that all utilities (electricity, water, gas) are operational. If the inspector is unable to access the property or utilities are not functioning, the inspection may need to be rescheduled at your expense. Failure to provide access or operational utilities may result in an incomplete inspection or additional fees.

10. Inspection Report Ownership & Use

The inspection report is provided exclusively for your use. The report may not be transferred, shared, or reproduced for third-party use without PPPI’s written consent. You acknowledge that third parties (e.g., realtors, lenders, insurers) may not rely on the report. PPPI retains all intellectual property rights to the inspection report.

11. Confidentiality & Data Privacy

PPPI will collect and securely store personal information (e.g., contact details, property specifics) solely for the purposes of conducting the inspection, delivering the report, and providing customer support. PPPI will not sell or disclose your personal information to third parties, except as required by law or with your explicit consent.

12. Indemnification

You agree to indemnify, defend, and hold harmless PPPI, its owners, employees, and contractors from any claims, liabilities, damages, or expenses arising from your use of the inspection services or report. This indemnification extends to claims by third parties and survives the termination of this agreement.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Minnesota. Any disputes arising from this agreement must first be resolved through mediation. If mediation is unsuccessful, disputes will be settled by binding arbitration in Washington County, Minnesota, in accordance with the rules of the American Arbitration Association (AAA). The arbitration decision will be final and binding. If arbitration is unenforceable, disputes will be resolved in a court of competent jurisdiction in Washington County, Minnesota. Both parties waive their right to a jury trial.

14. Modifications to Terms

PPPI reserves the right to update these Terms from time to time. Any changes will be posted on our website or communicated via email at least 30 days prior to implementation. Your continued use of our services after such changes constitutes acceptance of the updated Terms. Any updates will not apply retroactively to services already completed. If you disagree with any changes, you may terminate future services without penalty before the changes take effect.

15. Entire Agreement

These Terms constitute the complete and exclusive agreement between you and PPPI regarding home inspection services, superseding any prior agreements or understandings. By scheduling or engaging PPPI’s services, you acknowledge that you have read, understood, and agreed to these Terms.
